1.  Jurisdiction of VR&E Claims and Folders

III.ii.5.C.1.a.  Processing Applications for VR&E Under 38 U.S.C. Chapter 31

 
The station having jurisdiction of the geographical area where the Veteran resides processes applications under 38 U.S.C. Chapter 31, Vocational Rehabilitation and Employment (VR&E).
Processing includes
  • development of the application
  • determination of eligibility and entitlement
  • preparation of the Counseling/Evaluation/ Rehabilitation (CER) folder and other related folders, and
  • determination of the need for, and completion of, counseling.

III.ii.5.C.1.b.  Jurisdiction of the CER Folder After Entrance Into Training

 
The office having jurisdiction over the geographical area where the Veteran receives training maintains the CER folder once the Veteran enters 38 U.S.C. Chapter 31 training.

III.ii.5.C.1.c.  Jurisdiction of the CER Folder if the Participant Is Employed by VA

 
Department of Veterans Affairs (VA) employee CER folders must be maintained in a locked room or a locked cabinet by the station of origination having jurisdiction over the area in which he/she resides.

III.ii.5.C.2.a.  Types of Folders for Educational Training

 
All benefits administered by Education Service, including those based on 38 U.S.C. Chapter 3032, and 3310 U.S.C. Chapter 1606, and Section 903, Public Law (PL) 96-342 education claims, are processed by the regional processing offices (RPOs) using electronic folders maintained in the Image Management System.

III.ii.5.C.2.b.  Jurisdiction for Processing Education Claims

 
The Buffalo, Muskogee, or St. Louis RPOs handle all education claims.
The table below contains information regarding the RPOs that process the initial claims, based on information specified by the claimant.

III.ii.5.C.2.c.  Jurisdiction of Schools in the Philippines

 
The Manila Regional Office (RO) processes education claims if the school is in the Philippines.
Exception:  The Manila RO does not process claims under 38 U.S.C. Chapter 30.  Muskogee processes all 38 U.S.C. Chapter 30 claims if the school is in the Philippines.

Section 901, PL 96-342, claims are under the exclusive jurisdiction of the Waco RO.  The Waco RO uses an education folder for Section 901 claims.

III.ii.5.C.3.b.  Chapter 35 DEA Folders

 
RPOs in Buffalo, St. Louis, and Muskogee process applications for benefits under38 U.S.C Chapter 35.
The table below contains information about which RPO processes an application based on information provided by the applicant.  The office with jurisdiction over the education claim should maintain the Dependents’ Educational Assistance (DEA) folder.
